Probate
Probate is the term commonly used when talking about applying for the right to deal with a deceased person's affairs. It's sometimes called 'administering the estate'.Either the Executors named in the Will or the next of kin applies for a Grant of Probate. A Grant of Probate is a court order giving one or more people the legal authority to administer the estate of the deceased in order to distribute it correctly to the beneficiaries.
The two main types of the Grant of Probate are the Grant of Probate, where there is a Will and Letters of Administration where there is no Will.
Many people assume that their property and possessions will automatically go to loved ones after death, however, this is not always the case. Without a Will the strict inheritance laws called the Rules of Intestacy apply.
